These Terms of Use (“Terms”) govern your access to and use of NxtSale (the “Service”), operated by NxtStop / NxtSale (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.

1. The Service

NxtSale provides tools for live sellers, including a browser extension, dashboard, catalog matching, and related analytics. Features may change as we improve the product. The Service is an independent tool and is not affiliated with or endorsed by Whatnot Inc. or any other marketplace.

2. Accounts

You must provide accurate account information and keep your login credentials secure. You are responsible for activity under your account, including teammates you invite. We may suspend accounts that abuse the Service, violate these Terms, or create risk for other users.

3. Subscriptions & billing

Paid plans are billed through Stripe. Prices, renewals, trials, and promo codes are shown at checkout. Unless required by law, fees are non-refundable except where we expressly offer a money-back guarantee. Canceling stops future renewals; access continues through the end of the paid or trial period already purchased.

4. Acceptable use

You agree not to:

• Reverse engineer, scrape, or overload the Service
• Share extension connection keys outside your organization
• Use the Service for unlawful activity or to infringe others’ rights
• Misrepresent your identity or affiliation when contacting us

5. Your data

You retain ownership of your catalog, sales logs, and other content you upload. You grant us a limited license to host and process that data solely to operate and improve the Service. See our Privacy Policy for details.

6. AI features

Some features use third-party AI providers (for example vision or language models). Outputs may be inaccurate. You are responsible for reviewing logs, prices, and catalog matches before relying on them for business decisions.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted availability or error-free detection of every sale.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR LOST-PROFITS DAMAGES, OR FOR AMOUNTS EXCEEDING THE FEES YOU PAID TO US IN THE THREE MONTHS BEFORE THE CLAIM.

9. Changes

We may update these Terms by posting a revised version on this page. Continued use after changes means you accept the updated Terms.
